Terms of Use

These Terms of Use ("Terms") govern your access to and use of the iSunday mobile application ("App") and website ("Site"), operated by iSunday, Inc. ("iSunday," "we," "us," or "our"). By accessing or using our Services, you acknowledge that you have read, understood, and agreed to these Terms.

About Us

iSunday is a mobile application and online service developed by iSunday, Inc. Our platform connects single Christians who share similar values and a commitment to faith.

Eligibility and Account Registration

You must be at least 18 years old to access or use iSunday. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

To use iSunday, you must create an account using accurate, current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Use of Our Services

You may access and use the iSunday Services solely for lawful, personal, and non-commercial purposes, in compliance with these Terms and all applicable laws and regulations.

Legal and Acceptable Use

You agree not to use the Services to:

Violate, infringe, or misappropriate the rights of iSunday, its users, or third parties, including intellectual property, privacy, and publicity rights.

Engage in or promote illegal, defamatory, obscene, threatening, harassing, abusive, hateful, discriminatory, or otherwise objectionable activities.

Participate in spam, scams, fraudulent activities, or other misleading or deceptive practices.

Impersonate any person or entity or misrepresent your affiliation.

Security and Integrity

You agree not to:

Reverse engineer, decompile, disassemble, attempt to derive the source code of, or create derivative works based on the Services, except as permitted by applicable law.

Access or attempt to access areas of the Services that are not intended for public use.

Use automated means, such as bots, scrapers, or crawlers, without our express permission.

Introduce malware, viruses, or other harmful code that may compromise the security, integrity, or performance of the Services.

Interfere with or disrupt the safety, security, confidentiality, integrity, availability, or performance of the Services.

We reserve the right to investigate and take appropriate action, including removing content or suspending or terminating accounts.

Third-Party Services

Our Services may integrate with third-party services, such as analytics providers, attribution partners, or payment processors. Your use of any third-party service is subject to that provider’s own terms and privacy policy. We are not responsible for the content, policies, or practices of any third party.

Privacy

Our Privacy Policy governs how we collect, use, and share your personal information when you use the Services, and it is incorporated into these Terms by reference.

By using the Services, you acknowledge that you have read and agree to our Privacy Policy.

Content and Intellectual Property

Your Content

You retain ownership of the content you submit, upload, or display through the Services, including your profile information, photos, and messages ("User Content"). You are responsible for your User Content and for ensuring that it complies with applicable laws and these Terms.

License to Us

By using our Services, you grant iSunday a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, display, publish, and distribute your User Content solely to the extent necessary to provide, operate, and improve our Services.

Ownership of the Services

All rights, titles, and interests in and to the Services, including the App, Site, and all related software, designs, logos, trademarks, and other intellectual property, are and will remain the exclusive property of iSunday, Inc. and its licensors. You may not use our intellectual property without prior written permission, except as permitted under these Terms.

We respect the intellectual property rights of others and expect our users to do the same. Our Terms do not allow users to violate someone else's intellectual property rights when using our Services, including their copyrights and trademarks.

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, you may submit a notice using our Contact Form. Your notice must include the following information:

A description of the copyrighted work you claim has been infringed;

A description of where the material you claim is infringing is located within the Services;

Your address, telephone number, and email address;

A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf;

Your physical or electronic signature.

Before submitting a notice, you may wish to contact the user directly if possible. Resolving the issue informally may be quicker and more amicable for both parties.

Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, including removing the allegedly infringing content if warranted. In accordance with the DMCA and other applicable laws, we have a policy of terminating, in appropriate circumstances, users who are determined to be repeat infringers.

Termination and Suspension

Your Right to Terminate

You may stop using the Services and delete your account at any time by following the account deletion process available in the App.

Our Right to Suspend or Terminate

We may suspend or terminate your access to the Services or delete your account at our sole discretion if:

You violate these Terms or our other policies;

You create risk, harm, or legal exposure for us, our users, or others;

We are required to do so by law or by governmental request.

We may also disable or permanently delete your account if it remains inactive for an extended period of time.

Effect of Termination

Upon termination, you lose the right to access or use the Services.

Termination does not affect any rights and obligations that by their nature should survive, including ownership, intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions.

Availability and Discontinuation of Services

We strive to improve and expand our Services over time. Accordingly, we may add, modify, remove, or discontinue certain features, functionalities, or support for specific devices or platforms at any time.

Our Services may occasionally be interrupted due to maintenance, upgrades, network failures, or events outside of our control.

We also reserve the right to discontinue some or all of our Services at our sole discretion. In the event of a complete discontinuation of paid Services, we will provide advance notice and offer refunds for any prepaid, unused portions, as required by law.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT THEY WILL MEET YOUR EXPECTATIONS. WE DO NOT GUARANTEE THAT ANY CONTENT OR INFORMATION YOU PROVIDE OR ACCESS THROUGH THE SERVICES WILL BE SECURE OR WILL NOT BE LOST, CORRUPTED, OR ALTERED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INFORMATION, OR MATERIALS MADE AVAILABLE THROUGH THE SERVICES.

YOU USE THE SERVICES AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY USER CONTENT, THE CONDUCT OF OTHER USERS, THIRD-PARTY SERVICES, OR EVENTS BEYOND OUR REASONABLE CONTROL.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ISUNDAY, INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE (12) MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ISUNDAY, INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR IN CONNECTION WITH:

YOUR ACCESS TO OR USE OF THE SERVICES;

YOUR VIOLATION OF THESE TERMS OR ANY APPLICABLE LAW OR REGULATION;

YOUR USER CONTENT;

YOUR VIOLATION OF ANY RIGHTS OF ANY THIRD PARTY.

WE RESERVE THE RIGHT, AT OUR OWN EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER OTHERWISE SUBJECT TO INDEMNIFICATION BY YOU, IN WHICH EVENT YOU AGREE TO COOPERATE WITH US IN ASSERTING ANY AVAILABLE DEFENSES.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Dispute Resolution

Before initiating any legal action, you agree to first Contact Us to attempt to resolve any dispute informally.

If we cannot resolve the dispute within a reasonable time, you and iSunday agree that any disputes, claims, or controversies arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Santa Clara County, California.

You and iSunday consent to the personal jurisdiction and venue of these courts.

Time Limit to Bring a Claim

To the fullest extent permitted by law, any claim or cause of action you have arising out of or relating to these Terms or the Services must be filed within one (1) year after the claim or cause of action arose; otherwise, it is permanently barred.

Modifications to These Terms

We may update these Terms from time to time.

We encourage you to review them periodically to stay informed about any changes to our Services, practices, or legal requirements.

Miscellaneous

These Terms constitute the entire agreement between you and iSunday regarding your use of the Services and supersede any prior agreements.

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision under these Terms will not be considered a waiver of such right or provision.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
